The following Carpatic Design Ltd. (together with its affiliated companies and subsidiaries, collectively, “Carpatic Design“, “our,” “we,” or “us“) terms of service and the other Carpatic Design terms referred to below that govern specific services and activities (collectively, these “Terms“), and our additional standards, conditions, policies, guidelines and in-product disclosures, govern your access to and use of any and all the carpicars.com internet site and any and all versions and subdomains thereof and Carpatic Design applications (collectively, the “Website“), as well as any and all content, functionality and services offered on or through the Website or otherwise provided by us (each a “Service” and collectively, the “Services“).

Read these Terms to learn more about your rights and responsibilities as a person that accesses or uses the Website and/or any Services (“you“, “User” or “user“), provided that if you open an account on the Services on behalf of an organization or other entity, then (i) “you” and “User” includes you and that entity, and (ii) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf. By accessing or using any of the Website or any Services, creating an account on the Website (an “Account”) and checking the “I agree” or “I accept” or similar box, or otherwise accessing or using the Services, you (1) agree that you have read, understood, and agree to be bound by the terms and conditions of these Terms of Service (these “Terms”), as updated by us from time to time, (2) represent and warrant that the information you provide is accurate and not misleading, and (3) agree that you have read and acknowledge the collection and use of your information as set forth in our privacy policy (the “Privacy Policy”), whether or not you are a registered user of the Services. If you do not want to agree to the Agreement or the Privacy Policy, you must not access or use the Website or any Services.

1. Use of Our Services. Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable right to use the Website and the Services for your use only as permitted by the features of the Website and the Services and by the Agreement. Carpatic Design reserves all rights not expressly granted herein in the Website and the Services. Carpatic Design may revoke this right at any time for any reason or no reason.
2. Eligibility. You may access or use the Website and the Services only if you can form a binding contract with us, and only in compliance with the Agreement and all applicable local, state, provincial, national, and international laws, rules and regulations. Any use or access to any of the Website or the Services by anyone under 13 is strictly prohibited and in violation of these Terms.
3. Shops and Shop Terms. The Services provide a marketplace where Users (“Shop Owners”) can open a shop for display, marketing and sale of products (“Assets”) to other Users (each a “Buyer”) to purchase items under a limited license.
4. Purchases of Assets and License Terms. If you purchase an item or other Asset from Carpatic Design, such Asset, your purchase and your use of it are subject to additional license terms outlined in the applicable License Terms. If you make a purchase through the Services, the Carpatic Design return policy applies to any contemplated return.
5. Partners, Promotion and other Terms. If you sign up to be an affiliate, our Partner Terms will apply. We may offer promotions or contests through the Website from time to time, subject to additional terms posted for such promotions or contests.
6. Your Account. Your account gives you access to the services and features of the Website and Services that we may establish, maintain, and modify from time to time. You agree to: store all passwords and usernames securely; notify us of any unauthorized use or security breach; never share login details with anyone; accept responsibility for activity under your account; and never transfer, rent, or sell your account to another person.
7. Notifications and Emails. By providing us with your email address, you consent to Carpatic Design using it to send you Service-related notices, including any required by law. We may also send Newsletters and other messages. You can unsubscribe at any time by clicking “Unsubscribe” or by contacting carpaticgiveaways@gmail.com.
8. Certain Website and Services Rules. You agree not to: copy, distribute, or scrape any part of the Website; use automated systems to access the Website excessively; transmit spam; interfere with system integrity or security; overload our infrastructure; upload viruses or malware; harvest personal information; use the Website for unauthorized commercial solicitation; impersonate another person; interfere with the proper working of the Website; or bypass any access-restriction measures.
9. User Content. Some areas of the Services allow Users to post content such as profile information, comments, and images (“User Content”). You are entirely responsible for your User Content and represent that it does not infringe any third party’s rights, does not contain viruses, is not spam, and is not obscene, libelous, or objectionable. You grant Carpatic Design a royalty-free, worldwide, non-exclusive license to use, reproduce, and display your User Content in connection with the Services and our business. You agree not to post content that is pornographic, harassing, illegal, harmful to children, or otherwise objectionable.
10. Our Proprietary Rights. Except for your User Content, all materials on the Services — including software, images, text, graphics, logos, and trademarks — belong to Carpatic Design and its licensors (“Carpatic Design Content”). You agree not to sell, license, decompile, reverse engineer, modify, or create derivative works from any Carpatic Design Content.
11. Feedback. If you submit comments or ideas about the Website (“Ideas”), you agree that we are free to use them without attribution or compensation to you.
12. Monitoring and Enforcement; Termination. We reserve the right to monitor postings and user activity to ensure compliance with these Terms. We may terminate or suspend your access to the Website at any time, for any reason or no reason, without notice or liability.
13. Copyright Infringement. We take claims of copyright infringement seriously. If you believe any materials on the Website infringe your copyright, submit written notification to carpaticgiveaways@gmail.com including your signature, identification of the copyrighted work, identification of the infringing material, your contact information, a good-faith statement, and a statement made under penalty of perjury that you are authorized to act on behalf of the copyright owner.
14. Pricing, Charges, Payments, and Taxes. Certain aspects of the Services may be provided for a fee. You agree to pay all applicable charges. Payment gateways such as Stripe and PayPal may store your payment information. All refunds are at our sole discretion — contact carpaticgiveaways@gmail.com for refund inquiries. Subscription fees are billed in advance and are non-refundable.
15. Consent and Collection and Use of Data. We care about the privacy of our Users — see our Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your personal information as described there. Please only provide payment information in the designated areas of the site.
16. Security. We cannot guarantee that unauthorized third parties will never defeat our security measures. Notify us immediately at carpaticgiveaways@gmail.com of any unauthorized use of your account or any security breach.
17. Storage Practices and Limits. There is limited storage space for User Content on the Services. We have no liability for the deletion, loss, or failure to store any User Content.
18. Third-Party Links and Content. The Services may contain links to third-party websites not owned or controlled by Carpatic Design. You access such sites at your own risk.
19. Indemnity. You agree to defend, indemnify, and hold harmless Carpatic Design and its affiliates from any claims arising out of your use of the Website, your violation of these Terms, or your violation of any third party’s rights.
20. Disclaimer of Warranties. The Website and Services are provided “as is” and “as available,” without warranties of any kind, express or implied.
21. Disclaimer of Damages. Carpatic Design will not be liable for special, indirect, consequential, or similar damages, including loss of profits or data.
22. Limitation of Liability. Our total cumulative liability for all claims will not exceed the greater of $100 or the amount you paid us in the six months preceding the claim.
23. Governing Law. These Terms will be governed by the laws applicable in the jurisdiction where Carpatic Design operates, without regard to conflict of laws principles.
24. Arbitration and Class Action Waiver. For any dispute, you agree to first contact us at carpaticgiveaways@gmail.com to attempt informal resolution before pursuing formal action.
